In June we went to trial in Mercer County on a case involving a client who fell on a patch of ice and snow at a gas station, suffering head, neck, and back injuries. No decent offer was ever made before trial, so we did the only thing we could do - we went to trial. Unfortunately, the jury felt our client was more at fault than the gas station, so there was no recovery. We felt there were several errors at trial by the court, so post-trial motions have been filed.

A better result was achieved at arbitration in May, when we got a significant award for an elderly woman who tripped over a defective entrance to a convenience store, smashing several teeth and sustaining injuries to her face. The ironic thing is that, between the two cases, the Mercer County case was probably the better case. In the immortal words of former major league pitcher Joaquin Andujar - yaneverknow.

And just last week we successfully mediated a case in Erie County involving a young woman who was paralyzed from the waist down in a car crash. The case was a difficult one due to the lack of insurance for most of the potential defendants. However, we identified one defendant with sufficient insurance to cover our client's injuries and vigorously pursued them, despite several legal obstacles to recovery.
